[Tallahassee, FL] Senate leaders are wrong to argue that they can make limited changes to a redistricting plan that was found unconstitutional, Florida Democratic Party Chairman Rod Smith told reporters Tuesday.

Speaking on a conference call the day before a special redistricting session begins, Smith blasted Senate Reapportionment Committee Chairman Don Gaetz’s (R-4/Niceville) contention that the upper chamber can simply tweak its maps to answer the complaints of the Florida Supreme Court.

On Friday, the court threw out the Senate plan and specifically highlighted eight districts that justices said were unconstitutional. Senate leaders have suggested that the ruling essentially upheld all but 20% of the 40 districts drawn by the chamber – so minor renovations were needed.

“We’re not starting with a clean sheet of paper, as some of our critics wanted us to,” said Gaetz. “We’re starting I think with a roadmap that will help us get where we need to go.”

But Smith said that’s not possible, in part because redrawing the eight districts will set off a chain reaction in the surrounding districts that could ripple across the state.

All districts have to be relatively equal in population, meaning any change that brings in population from or sheds population into a district not mentioned by the court’s order will have to be offset elsewhere.

“Contrary to what Senator Gaetz suggests, the score is not 32-8. The score is 0-1,” Smith said. ” … There is no such thing as tweaking the map.”

Gaetz did not return a call seeking a response.

Smith also said Democrats would suggest their own map in the coming session. Efforts by party leaders to cobble together an alternative plan largely floundered in the regular session because black Democrats revolted against plans they saw as weakening minority-friendly districts.

“Our map will be designed to implement the will of the people,” Smith said.

No decision has been made on whether to launch a more protracted battle against the House map, which was upheld by the Supreme Court but could be challenged again with evidence and specific claims, Smith said.

The comments came on the heels of a report by The Miami Herald that Senate lawyers were seeking to delay until after the November elections a trial court’s consideration of the Congressional plan approved by the Legislature.

Attorneys for the chamber argued that if the court were to invalidate the plan, it could lead to a tangled attempt to redraw the maps, which would still need to be pre-cleared by the U.S. Justice Dept. before qualifying for party primaries begins.

“It is not necessary – and is wholly impractical and unreasonable – to resolve Plaintiffs’ claims in time for any remedy to be implemented before the 2012 elections,” according to a copy of the filings posted on the Herald‘s website.

But a coalition of voting-rights groups slammed that reasoning and said it could call into question the rights of anyone elected from those maps.

“Moreover, assuming that Plaintiffs’ claims are meritorious, the delay requested by Defendants will guarantee that Plaintiffs, along with all Florida voters, will suffer the irreparable harm of the election of members of Congress from districts that violate the Florida Constitution,” attorneys for the coalition wrote.

[Miami Gardens, FL] Early yesterday morning, a dead man was discovered outside a home owned by superstar South Florida rapper Rick Ross.

The victim, Gregory Paul Nesbitt, 39, had been shot multiple times. It has been stated by authorities that Ross was not at the home at the time of the shooting. The 3-bedroom house is used by Ross as a recording studio, according to The Miami Herald.

NBC Miami says the house was purchased by Ross in 2010 and is is registered under William L. Roberts II, the rap star’s birth name.

Rick Ross has had a variety of incidents happen to him over the past year which has kept him in the news.

On March 26, 2011, Ross was arrested – along with Jason Peters of the Philadelphia Eagles – at the Hilton in Downtown Shreveport, LA, for possession of marijuana after a strong odor was detected coming from Ross’ hotel room.

On October 14, 2011 Rick Ross suffered two seizures in the same day, the first attack left him unconscious and requiring CPR. He had the second seizure on a plane and was rushed to the emergency room.

And there still is no release date for his oft-delayed new album God Forgives, I Don’t, originally due last year. To tide his fans over until God drops, Ross released the Rich Forever mixtape on Jan. 6 of this year.

[Miami, FL] Rep. Richard Steinberg (D-106/Miami Beach) quit the House effective immediately on Friday after admitting earlier in the week that he sent inappropriate, unwanted texts to a federal prosecutor in Miami.

Steinberg announced his resignation in a statement sent out by a spokesman.

“The events of the past week have been difficult for my family, for me and for everyone involved,” Steinberg said in the statement.

“After much consultation with my family, my friends and my colleagues in the Democratic caucus—and after some time for quiet, personal reflection—I have decided to resign from my position, effective today, as a member of Florida’s House of Representatives,” he said.

Steinberg, 39, was confronted after The Miami Herald reported that he was under investigation by federal officials in connection with anonymous text messages sent to Assistant U.S. Attorney Marlene Fernandez-Karavetsos, and he admitted that he sent them.

Federal investigators said the messages were sent over three months last year and Steinberg refused to identify himself to Fernandez-Karavetsos as the sender. The U.S. Secret Service traced the messages to Steinberg.

“With the support of my family, my friends and my colleagues, I will remain home to attend to my and my family’s personal affairs,” Steinberg said in the statement released Friday.

“As I did earlier this week, I want to once again, very directly and sincerely, apologize to everyone I have hurt. I hope that you will respect my and my family’s privacy.”

Rep. Richard Steinberg has resigned

Richard Steinberg is a former Miami Beach commissioner, and was elected to the House in 2008, filling a seat vacated by former Rep. Dan Gelber, who then went to the state Senate. Steinberg is married with one child.

Throughout his time in the House, Steinberg has been a vocal Democrat in the House, and a leading voice for protection of children. One of his primary efforts has been legislation aimed at requiring booster seats for children too big for car seats.

The Herald reported earlier this week that Fernandez-Karavetsos, who is married to George Karavetsos (also a federal prosecutor), had repeatedly asked the anonymous texter to stop sending her messages.

As recently as last week, Steinberg voted in committee for a bill (HB 1099) that expands the definition of aggravated stalking to include threats made by text message.

House Democratic Leader Ron Saunders (D-120/Key West), sent out a terse statement, saying merely that Steinberg had resigned that the “concerns of everyone involved are in our thoughts and prayers.”

Gov. Rick Scott could set a special election to replace Steinberg before the November general election.

[Miami, FL] Rep. Richard Steinberg has admitted sending inappropriate and harassing text messages to a Miami prosecutor and is under federal investigation, The Miami Herald reported late Wednesday.

Federal agents investigating messages sent for more than three months last year to Assistant U.S. Attorney Marlene Fernandez-Karavetsos were traced by the U.S. Secret Service to Steinberg, a Miami Beach Democrat representing District 106.

Steinberg – who used the screen name “itsjustme24680″ – took responsibility for sending the messages in a statement to The Miami Herald, which first reported the story.

One of the exchanges opened with: “Sexxxy mama?”

“I acknowledge and take full responsibility for sending inappropriate and unsolicited messages to Mrs. Marlene Fernandez-Karavetsos, whom I have known for more than 15 years,” Steinberg said in the statement.

“I deeply regret and wholeheartedly apologize for the disrespect that I have shown her, her husband and my constituents. Most importantly, words cannot express how sorry I am to my wife, for the disrespect I have shown her, and my entire family,” he said.

Steinberg, 39, hasn’t been charged and was in a House committee on Wednesday.

Steinberg, a former Miami Beach commissioner, was elected in 2008 and is the son of former Sen. Paul Steinberg. The Herald reported that Fernandez-Karavetsos, who is married, and had repeatedly asked the anonymous texter now identified as Steinberg to stop texting her, declined to comment.

In a follow-up report out by the Herald, the paper points out that Steinberg voted for several laws that come down hard on stalkers. One of those was as recently as earlier this week.

Most recently, Steinberg appeared on Sunshine Slate for speaking out in opposition against the “inspirational messages bill – otherwise known as the school prayer bill.

“The reality is, it’s nothing more than a euphemism for prayer,” said Richard Steinberg. “It’s because we can’t say ‘prayer’ in a bill, because we know that the courts will strike it immediately.”

[Miami, FL] The Miami Dolphins are reloading once again, trying to recapture the magic for a struggling, yet endearing team that hasn’t seen serious playoff action since the Dan Marino era or a Super Bowl victory since taking back-to-back Lombardi trophies in 1972 and 1973.

A major part of their current rebuilding plan is their just-confirmed acquisition of former New Orleans Saints running back Reggie Bush, according to The Miami Herald. Bush and the Saints won the Super Bowl in 2010.

Bush is a powerful force, rushing 524 times for 2,090 yards and catching 294 passes for 2,142 yards in five years of action. He also racked up 29 touchdowns. But his numbers fall short of being truly awesome as he has been plagued with injuries throughout his career.

The painful truth: Since 2006, Bush has only completed a single full-game season. Last year he was a disappointment, playing in only eight games and rushing for a paltry 150 yards because of a broken right fibula. That injury was the fourth such major physical problem for Bush, whose  injury history includes damage to the posterior cruciate ligament (2007), and the meniscus (2008). In 2009, he suffered a bruised knee.

The Miami Herald says General Manager Jeff Ireland burned the midnight oil among others to finalize a deal with the Saints bringing Bush to the Dolphins via a two-year renegotiated contract. Bush will get nearly $10 million during that period, including a $2.5 million signing bonus.

The deal will be finalized Friday at 6 p.m. But because of the NFL’s newly inked contract with its players union, Bush will not be able to hit the Miami practice turf until Aug. 4.

Since his college days, Bush has been a magnet for controversy and media coverage. Bush won the 2005 Heisman Trophy at USC, but on Sept. 14, 2010, he gave it back as USC suffered a two-year postseason ban, the loss of football scholarships and vacated wins in the school’s 2004-05 championship season – all because Bush got special benefits as a player there.

Dolphins coach Tony Sparano will have his hands full this season keeping Bush healthy and balanced to get the most of his the newest member of the Fish.

[Miami, FL] The Miami Herald‘s “Naked Politics” blog is reporting that a rumor is swirling around South Florida that U.S. Senator Marco Rubio may be close to signing a book deal.

According to the report, however, Rubio’s people won’t confirm that such is the case. But they aren’t denying it either.

Rubio’s first book, 100 Innovative Ideas for Florida’s Future, was little more than spelled-out policy positions building up to his tenure as Florida House speaker. While it helped him in Tallahassee, little was made of the book outside of the capitol.

With his star ever-rising and mentions of a possible VP nomination in the 2012 race, it would be a wise time to drop a tome on the public eager to get some Marco on their shelves and into their iPads.

The dark legacy of disgraced former Broward County Sheriff Ken Jenne (full name Kenneth C. Jenne II) lives on. The superstar state senator-turned Broward County Sheriff quit in 2007 after pleading guilty to mail fraud and federal tax evasion charges. He was a very bad man.

He was eventually sentenced to a slightly more than a year – a year and a day, believe it or not – in the federal prison system  for his criminal actions.

This joker even has a connection to part-time presidential candidate and full-time huckster Donald Trump: Back in 2006, Jenne was all over the news as a high-profile witness in a trial pitting the Trumspter against the developers of the Seminole Hard Rock.

Now Jenne is making headlines once again. And, as usual, it is not very good. Unless you owned the company that oaked this guy’s opulent command center.

In an investigative report obtained by The Miami Herald, it seems that wonder boy decorated his office in the fanciest of manners  to the tune of $1.6 million.And it wasn’t just from his budget – it was money from a public grant fund.

Described as a “lair,” the top-of-the-line digs included expensive wood features everywhere and a jaw-dropping $438,000 in furniture (that also is used by his top leadership).

In the report, Jenne declared that “it was his money and he would do what he wanted with it.’’ The Miami Herald also noted that Congress wasn’t impressed with Jenne’s use of the money and, in hearings, featured the sheriff’s excess as an example of what not to do with grant funds.

The Miami Herald‘s Laura Figueroa has a nice in-depth look at tourism’s almost surprising up-tick counterbalanced with the continued devastation as result of the nation’s biggest natural disaster:

 

All-terrain vehicles still rumble across the eight-mile stretch of Pensacola Beach each morning, driven by workers looking for tar balls. One year after crude from the Deepwater Horizon oil rig explosion reached Florida’s shores, cleanup crews are still unearthing the sticky hardened bits of oil.

“They’re about the size of your finger nail,” said Buck Lee, a lifelong Pensacola native and executive director of the Santa Rosa Island Authority, which oversees beach projects.

Two incidents highlight the long held belief that South Florida police departments – in particular, those with Miami in their name – have corrupt officers among their ranks. Historically, they do not have a good record for being on the up and up.

And just when we thought it was getting better, it begins again.

According to The Miami Herald, Robert Asanza, a six-year veteran of the Miami police, was nabbed by the FBI and charged with cocaine possession with intent to distribute. Apparently, he took coke and weed from a suspect and kept it on his person.

It should make you feel warm and cozy that Asanza (a local boy and Marine Corps vet) is part of the crime suppression unit. Or more accurately, was. A conviction could land him 20 years in prison.

His supervisor is also involved in the investigation.

More Protecting & Serving

The Miami Herald also has this shocker: “A West Palm Beach couple who filmed Monday morning’s deadly officer-involved shooting on South Beach has accused officers of intimidation, destroying evidence and twisting the facts in the chaos surrounding the Memorial Day shootings.”

While police have said that they haven’t even had a complaint filed.  Would you go to the police to complain that officers were violently intimating you into handing over your video? No you wouldn’t. You go to the media, and that’s exactly what the West Palm Beach couple did.

Especially since the astute couple sneakily kept the SIM card from the cell phone that police smashed in an effort to hide what happened.The couple says that other bystanders also were victimized by having their cell phones smashed.

Now the video is up for sale and the cops will no doubt look really really bad when it hits the airwaves.

It is time for the Justice Department, or at bare minimum Attorney General Pam Bondi, to step in and take over, and tell cops that smashing cell phones or video cameras is against the law (destroying evidence) and undermines confidence in all law enforcement.

There is a similar case in Orlando, which leads you to believe that this heavy-handed police action is widespread and without repercussion. And in my neighborhood, sheriffs regularly shake down pedestrians and bicyclists without probable cause.

Badged thuggery is way worse than any criminal activity. These guys and girls on the force have all of the power behind them. That’s why they call it a “force.” The only way they ever get caught is when somebody captures it on video. But that’s still no guarantee (Rodney King, anyone?).

It is time to get rid of these bad cops and hire some respectable people worthy of the badge. We can respect them. These guys, not so much.

As reported by The Miami Herald, the son of newly elected state representative Daphne Campbell (D-Miami Shores) stands accused of defrauding Medicaid out of $299,000 by billing the federal agency for services that were never provided, the result of a two-year investigation.

Gregory Campbell, 28, is charged with a host of first-degree felonies, including Medicaid fraud, organized fraud and grand theft.

Campbell was arrested May 12 and is being held in the Miami-Dade County jail. The Florida Attorney General’s affidavit paints an ugly picture of Campbell and his alleged criminal activity – the representative’s son was double-dipping the system by billing Medicaid twice for the same patient at two different adult family care centers.

He also billed the government for recipients that never even lived at either of the facilities in question. Campbell then split the money with Percival Wignall, one of the owners of one of the two retirement homes where the fraud took place.

A Family Affair

Apparently, caring for the elderly is the family business. And that business hasn’t always been good – even before this shocking revelation.

Back in 2005, the elder Campbell (a registered nurse) was accused of mistreating, neglecting and ultimately causing the deaths of nursing home residents at facilities she was running at the time. She was eventually cleared of all charges.

Today, Rep. Campbell is the owner of Florida Nurses Home Health Agency, a specialist care referral service for home-bound patients.
